DEPORTATION DEFENSE

From representing clients during law school under supervised mentors to beginning this immigration practice as a nonprofit deportation defense organization, Tara Kennedy brings over 12 years of trial work in all phases of immigration and deportation proceedings as well as appeals.

Please telephone if you may soon be detained or if you know someone who has been detained.  Tara Kennedy has represented clients facing deportation for many different reasons.  Assistance is provided for cases whether the deportation is based upon illegal entry, overstay, violation of status, or criminal conduct.

If you are facing deportation because of a criminal conviction, our office can help you.  We have experience and expertise in criminal cases representing non-citizens facing deportation if convicted. During years our law firm has been receiving and increasing number of referrals from criminal attorneys in this specialized area of criminal defense.

One of the most stressful and frightening experiences that a  family with a noncitizen member  faces is the prospect of forced deportation from the United States.  Our law firm is dedicated to defending the rights of immigrants in deportation and removal cases.   We can represent you in every aspect of immigration trials.

If eligible, individuals in removal proceedings can apply for various immigration benefits, which, if granted, provide relief from removal such as adjustment of status to legal permanent residency or cancellation of removal.  Eligible individuals may also seek asylum or withholding of removal as well as other forms of protective relief.

Defending against deportation requires experience in providing a proper and aggressive defense.  Our services include:

  • Deportation & removal
  • Exclusion
  • Bond Hearings
  • Post Conviction Proceedings
  • Asylum
  • Temporary Protected Status
  • Cancellation of Removal
  • Withholding of Deporation
  • Termination of Proceedings
  • Application to Adjust to Legal Permanent Residency Status
  • Application for Waivers
  • Naturalization/Citizenship in Proceedings
  • Appeals to the Board of Immigration Appeals
  • Appeals in Federal Court

Our representation in deportation proceedings may involve the preparation and presentation of an application for relief from deportation, removal or exclusion and the collection of related, supporting documents.  At times, our representation may require an argument made either orally or through a written legal brief.  We counsel our clients about what will happen during the immigration hearing, the strategies involved and ensure that they are properly prepared for their day in court.  At the immigration court hearing we present witnesses in support of the application for cases in which witnesses are appropriate, and assist a well-documented application to the judge.  If an appeal is necessary, we prepare the appropriate legal brief to the Board of Immigration Appeals.
